Welcome to Car Market Me Limited (“Car Market Me,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your use of our website and vehicle marketplace platform (the “Platform”). By accessing or using the Platform, you agree to be bound by these Terms.

  • “Buyer” means any individual or business who uses the Platform to search for and enquire about vehicles.
  • “User” means any person who accesses or uses the Platform, including Dealers and Buyers.
  • “Listing” means a vehicle advertisement posted by a Dealer on the Platform.
  • “Content” means all information, data, text, images, and other materials uploaded to or displayed on the Platform.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years old to use our Platform. By using the Platform, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Dealer Account Registration

To list vehicles on the Platform, Dealers must:

  • Provide accurate, complete, and current business information
  • Maintain the security and confidentiality of account credentials
  • Notify us immediately of any unauthorized use of their account
  • Be legally entitled to sell or advertise the vehicles they list
  • Hold all necessary licenses and permits to operate as a vehicle dealer in their jurisdiction

3.3 Account Responsibilities

You are solely responsible for all activities that occur under your account. We are not liable for any loss or damage arising from unauthorized use of your account.

4. Platform Services

4.1 Our Role

Car Market Me operates as a marketplace platform that:

  • Connects Dealers who wish to advertise vehicles with potential Buyers
  • Facilitates communication between Dealers and Buyers through enquiry forwarding
  • Provides a platform for vehicle listings to be displayed and searched

4.2 We Are Not a Party to Transactions

Car Market Me is not involved in the actual sale, purchase, or transfer of vehicles. We do not:

  • Own, sell, or purchase any vehicles listed on the Platform
  • Act as an agent for Dealers or Buyers
  • Have control over the quality, safety, legality, or accuracy of Listings
  • Participate in or control any transaction between Dealers and Buyers

4.3 No Warranty on Listings

We do not verify, endorse, or guarantee:

  • The accuracy or completeness of any Listing information
  • The quality, condition, safety, or legality of vehicles advertised
  • The ability of Dealers to complete a sale
  • The truthfulness or reliability of Dealer representations

5. Dealer Obligations

5.1 Listing Requirements

Dealers must ensure that all Listings:

  • Contain accurate and truthful information about vehicles
  • Include clear, genuine photographs of the actual vehicle being sold
  • Comply with all applicable laws and regulations
  • Do not infringe on any third-party intellectual property rights
  • Are for vehicles that the Dealer is legally entitled to sell
  • Include accurate pricing information

5.2 Prohibited Listings

Dealers must not post Listings for:

  • Stolen vehicles or vehicles with fraudulent documentation
  • Vehicles that do not exist or are not available for sale
  • Vehicles that violate any laws or regulations
  • Counterfeit or illegal goods of any kind

5.3 Response to Enquiries

Dealers agree to:

  • Respond to Buyer enquiries in a timely and professional manner
  • Provide additional information about vehicles when reasonably requested
  • Conduct all transactions honestly and in accordance with applicable laws

5.4 Compliance with Laws

Dealers are solely responsible for:

  • Complying with all applicable vehicle sales laws and regulations in their jurisdiction
  • Obtaining and maintaining all necessary licenses and permits
  • Collecting and remitting any applicable taxes
  • Ensuring vehicles meet all safety and emissions standards
  • Providing accurate documentation and disclosure to Buyers

6. Buyer Obligations

6.1 Buyer Responsibilities

Buyers agree to:

  • Provide accurate contact information when making enquiries
  • Conduct their own due diligence on vehicles before purchase
  • Inspect vehicles and verify information provided by Dealers
  • Comply with all applicable laws when purchasing vehicles

6.2 No Reliance on Platform

Buyers acknowledge that:

  • They are responsible for verifying all vehicle information
  • They should inspect vehicles in person before purchase
  • They should obtain independent vehicle history reports and inspections
  • Car Market Me makes no representations about any vehicle listed

7. Prohibited Conduct

All Users must not:

  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights of others
  • Post false, misleading, or deceptive information
  • Attempt to defraud or harm other Users
  • Engage in harassment, abuse, or threatening behavior
  • Use automated systems (bots, scrapers) to access the Platform without permission
  • Interfere with or disrupt the Platform’s operation
  • Circumvent any security features of the Platform
  • Impersonate any person or entity
  • Collect User information without consent
  • Post spam, advertising, or promotional content (except authorized Dealer Listings)

8. Intellectual Property Rights

8.1 Platform Ownership

All intellectual property rights in the Platform, including its design, software, logos, and trademarks, are owned by or licensed to Car Market Me. You may not copy, modify, distribute, or create derivative works without our express written permission.

8.2 User Content

By posting Content on the Platform, you:

  • Grant us a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your Content for the purpose of operating the Platform
  • Represent that you own or have the necessary rights to the Content
  • Warrant that your Content does not infringe on third-party rights
  • Retain ownership of your Content

8.3 Content Removal

We reserve the right to remove any Content that violates these Terms or that we deem inappropriate, without notice.

9. Data Protection and Privacy

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your personal information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

  • Dealers are responsible for handling Buyer data in compliance with applicable data protection laws

10. Payment Terms

10.1 Dealer Fees

If applicable, fees for Dealer accounts and Listings will be communicated separately and may include:

  • Subscription fees

10.2 Payment Obligations

All fees are non-refundable unless otherwise stated. Dealers agree to pay all applicable fees on time.

10.3 No Transaction Fees

Car Market Me does not charge transaction fees or commissions on vehicle sales between Dealers and Buyers. Payment for vehicles is made directly between Dealers and Buyers.

11. Disclaimers and Limitation of Liability

11.1 Platform “As Is”

THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

11.2 No Guarantee of Results

We do not guarantee that:

  • The Platform will be uninterrupted, secure, or error-free
  • Listings will result in sales
  • Information on the Platform is accurate or reliable
  • Any defects will be corrected

11.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAR MARKET ME SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR USE, ARISING FROM:

  • Your use or inability to use the Platform
  • Any transaction between Dealers and Buyers
  • Any Content posted by Users
  • Unauthorized access to your account or data
  • Any other matter relating to the Platform

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR £100, WHICHEVER IS GREATER.

11.4 User Disputes

You are solely responsible for your interactions with other Users. Car Market Me is not obligated to intervene in disputes between Users but may do so at our discretion.

12. Indemnification

You agree to indemnify, defend, and hold harmless Car Market Me, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, and expenses (including legal fees) arising from:

  • Your use of the Platform
  • Your violation of these Terms
  • Your violation of any rights of others
  • Your Content posted on the Platform
  • Any transaction or dispute between you and another User

13. Termination

13.1 Termination by You

You may terminate your account at any time by contacting us at ben@carmarketmiddleeast.com (subject to terms and conditions).

13.2 Termination by Us

We may suspend or terminate your access to the Platform immediately, without notice, if:

  • You breach these Terms
  • We suspect fraudulent or illegal activity
  • Required by law
  • We cease operating the Platform

13.3 Effect of Termination

Upon termination:

  • Your right to use the Platform ceases immediately
  • We may delete your account and Content
  • Outstanding payment obligations remain due
  • Provisions that by their nature should survive termination will continue to apply

14. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify Users of material changes by:

  • Posting the updated Terms on the Platform with a new “Last Updated” date
  • Sending notification to registered Dealer email addresses (where applicable)

Your continued use of the Platform after changes constitutes acceptance of the modified Terms. If you do not agree to the changes, you must stop using the Platform.

15. Modifications to Platform

We reserve the right to modify, suspend, or discontinue any aspect of the Platform at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Platform.

16. Governing Law and Jurisdiction

16.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of England and Wales.

16.3 UAE Users

For Users located in the UAE, these Terms also comply with applicable UAE laws. Nothing in these Terms affects your statutory rights under UAE consumer protection laws.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Car Market Me regarding the Platform.

17.2 Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms will not constitute a waiver of that right or provision.

17.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign these Terms without restriction.

17.5 No Third-Party Beneficiaries

These Terms do not create any third-party beneficiary rights.

17.6 Force Majeure

We are not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including acts of God, war, terrorism, riots, natural disasters, or technical failures.
